Off-Grid Living in Athens, Maine

Athens, Maine is one of those towns that trips people up because it doesn't have a general, town-wide zoning ordinance. I want to be upfront about what that does and doesn't mean for off-grid plans.

Zoning: Outside of shoreland areas, I found no comprehensive zoning code adopted by the Town of Athens. The only confirmed land-use rule is the state-mandated Shoreland Zoning Ordinance, which Athens adopted using the State of Maine's model guidelines. It kicks in within 250 feet of great ponds, rivers, and freshwater wetlands, and within 75 feet of streams. If your land is outside those buffers, raw land use appears to be largely unregulated at the zoning level, but you should still confirm this with the Town's Code Enforcement Officer before you assume anything, since interior parcels could still be subject to unwritten practice or future changes.

Dwellings, tiny homes, RVs: Inside the shoreland zone, Athens' ordinance is specific: if you park an RV, tent, or similar shelter on-site for more than 120 days a year, the town treats it like a residential structure, meaning you need to meet all the same requirements, including wastewater disposal. There's also a one-campsite-per-lot limit and water-body setbacks within that zone. Outside the shoreland buffer, I did not find a town rule addressing RVs or tiny homes, which suggests more flexibility, but it's not something I can confirm as officially "permitted."

Building permits: Athens has a named Code Enforcement Officer (Terriann Lamontagne, per the 2025 Town Report) who administers shoreland zoning and presumably general building compliance. Maine's statewide building code (MUBEC) is optional for towns under 4,000 residents, and I could not locate a specific Athens building permit ordinance or fee schedule on the town's official site. Call the Town Office to find out what, if anything, is required for new construction.

Septic: Maine's Subsurface Wastewater Disposal Rules set the baseline statewide, enforced locally through a Local Plumbing Inspector, often the same person as the CEO. Athens' own ordinance language only specifically requires wastewater disposal for shoreland structures used more than 120 days a year. Composting toilets would fall under this same state framework; confirm specifics with the town's plumbing inspector.

Greywater, rainwater, wells: I found no Athens-specific ordinances on any of these. State baselines apply by default: Maine's Water Well Commission rules for wells, and the state plumbing code for greywater and rainwater systems. Treat these as "not confirmed locally" rather than assuming a green light.

Living off-grid/disconnected from utilities: There's no explicit town ban I found, but the 120-day shoreland rule implies that year-round occupancy there triggers full residential requirements, including septic. Outside the shoreland zone, this is genuinely unclear territory, so a call to the Code Enforcement Officer is worth it before you commit to a plan.

Bottom line: Athens is relatively permissive on paper because of the missing general zoning ordinance, but that also means fewer explicit protections and more reliance on state rules and local discretion. Confirm details directly with the town.
