Off-Grid Living in Tucker County, West Virginia

I've been digging into Tucker County, West Virginia for folks looking at off-grid land in that corner of the Alleghenies, and here's what I found, plus where the picture is still fuzzy.

Zoning: Tucker County itself doesn't appear to have a countywide zoning ordinance. That's not unusual for rural West Virginia counties. What's more interesting is that individual towns are handling it on their own. The Town of Davis currently has no zoning districts in place, though a 2023 zoning study shows the town is actively working toward adopting one, and any ordinance it passes has to be filed with the Tucker County Clerk. Meanwhile, Canaan Valley, an unincorporated resort area, has its own Board of Zoning Appeals with an appointed inspector, which tells me there's a special zoning district covering that specific area. Outside of Davis and Canaan Valley, raw land occupancy in the unincorporated county looks largely unregulated by zoning, but I couldn't confirm that for certain, so if you're eyeing a specific parcel, it's worth a call to the county commission.

Dwellings, tiny homes, RVs: I couldn't find an official Tucker County or town code that specifically addresses tiny homes or RVs as dwellings. This likely falls under whatever building permit and zoning rules apply where the land sits, so confirm directly with the county building office and, if relevant, the town hall.

Building permits: This is where Tucker County stands out from a lot of rural WV counties. The Tucker County Commission actually issues its own building permits countywide, according to an official permit-instructions document posted on the county's site. That's different from counties like Monongalia, where there's no county-level enforcement outside incorporated towns. If your land is inside Davis town limits, Davis runs its own separate permitting process.

Septic and composting toilets: The Tucker County Health Department handles permitting and inspection of septic systems, operating under West Virginia's Bureau for Public Health framework. Privies, which function similarly to composting toilets, are allowed under the same statewide process in situations where a conventional septic system isn't feasible.

Greywater: No county-specific rule here; it inherits the state baseline, meaning greywater disposal has to be part of an approved onsite sewage design reviewed through the state's Office of Environmental Health Services and administered locally by the county health department.

Rainwater harvesting: No county restriction turned up in my research, and West Virginia doesn't appear to restrict it at the state level either, so this looks fine for non-potable uses.
