Off-Grid Living in Unicoi County, Tennessee

Unicoi County is one of those Tennessee places where the answer to "can I do that off-grid?" really depends on whether your land sits inside the Town of Erwin, the Town of Unicoi, or out in the unincorporated county. I want to be upfront about that structural quirk before anything else, because it changes who you call.

Zoning. I could not find a general countywide zoning ordinance for unincorporated Unicoi County on the county's own website; the county's Planning and Development page mostly directs you to whichever town or community your parcel is in. That suggests unincorporated land may default to Tennessee's common rural pattern of no zoning at all, but I'm not treating that as confirmed. Inside town limits it's a different story: the Town of Unicoi has its own zoning ordinance and an interactive parcel map, and the Town of Erwin runs its own planning and building department. If your land is inside either town, their zoning code controls, not the county.

Dwellings, tiny homes, RVs. I found no Unicoi County-specific rule addressing tiny houses, RVs as permanent dwellings, or the state's Appendix Q tiny-home code. Absent a local rule, the state baseline applies, but you should confirm directly with whichever town or the county planning office covers your parcel.

Building codes. Tennessee allows counties and cities to "opt out" of the statewide residential code by a two-thirds vote of their legislative body. Whether unincorporated Unicoi County has opted out is not confirmed from what I found, so check the state's opt-out jurisdiction list yourself. Inside Unicoi town limits, though, the town has adopted the 2012 International Residential Code, International Fire Code, and 2009 IECC, and building inspections are required for new structures. Erwin runs a comparable permitting process through its own building department.

Septic and composting toilets. Septic systems statewide, including here, need a Septic System Construction Permit under Tennessee Department of Environment and Conservation (TDEC) oversight, with the Unicoi County Health Department handling the local environmental health piece. I did not find a composting-toilet exemption specific to Unicoi County, so the state's baseline (NSF 41-certified units, no blanket exemption from septic rules) applies.

Greywater and rainwater. No county-specific greywater rule turned up, so the state plumbing baseline applies and local septic permitting could still touch on it, so ask the Health Department. Rainwater harvesting appears unrestricted at both state and local level, with nothing in county or town code limiting it.

Wells and utilities. No county well ordinance surfaced; the state Water Well Act framework governs drillers. Within Erwin and Unicoi town limits, most water comes from utility districts (Unicoi Water Utility District, Erwin Utilities, or Johnson City Water) rather than private wells, and a Certificate of Occupancy is required for structures needing electric, water, or wastewater hookups in Erwin. Out in unincorporated county areas without municipal service, well-and-septic setups are the norm.

Bottom line: unincorporated Unicoi County looks lightly regulated on paper, but that's partly just an absence of confirmed documentation, not a guarantee. If you're anywhere near Erwin or Unicoi town limits, assume town rules apply and call ahead.
