Off-Grid Living in Passaic County, New Jersey

If you're looking at land in Passaic County, New Jersey for an off-grid setup, the first thing I want you to understand is that Passaic County itself doesn't zone land. Under New Jersey's Municipal Land Use Law, zoning authority sits with each of the county's 16 municipalities: Wayne, Clifton, Paterson, Passaic City, Pompton Lakes, Hawthorne, and the rest. The county's Planning & Economic Development office is a resource and reviews some larger subdivisions, but whether you can occupy raw land, park an RV, or build a tiny home is decided town-by-town. That means my notes here can only point you toward the pattern, not a single answer, and you have to check your specific municipality's ordinance.

For dwellings, tiny homes, and RVs, I found a good example in Wayne Township's code, which restricts storing RVs, trailers, and mobile homes in front yards and in certain commercial areas. That's a Wayne rule, not a county or state one, and other towns in the county may be stricter or looser. Don't assume one town's rule applies elsewhere in Passaic County.

Building permits run through each municipality's construction office under New Jersey's Uniform Construction Code, but Passaic County does maintain a Construction Board of Appeals, a quasi-judicial body that hears appeals when a property owner disputes a municipal construction official's decision. That's a real county-level function even though the permits themselves are local.

Septic systems and private wells are where the county Health Department actually does something concrete: its Environmental Health Division handles approvals and inspections of septic systems and wells for member municipalities, working under New Jersey DEP's statewide well-construction standards. I did not find anything specific to composting toilets at the county level, so treat that as governed by local health officer discretion under the state baseline until you confirm otherwise with the Health Department.

Greywater reuse and rainwater harvesting turned up nothing at the county level in my research, no ordinance, no health department guidance page. That leaves both in the same unclear position they occupy at the state level, so I can't tell you it's clearly permitted or restricted here.

On utility disconnection, I found no standalone Passaic County rule requiring a hookup to public water or sewer. In practice, though, getting a municipal Certificate of Occupancy typically requires the town to sign off on an approved water supply and sewage method (public or an approved private well and septic), so full off-grid disconnection tends to be constrained by that Certificate of Occupancy process rather than by any explicit county law.

Bottom line: for anything land-use related, your municipality is the real authority. For septic, wells, and construction appeals, the county Health Department and Construction Board of Appeals are the offices to know.
