Off-Grid Living in Nemaha County, Kansas

I've been digging into Nemaha County, Kansas for anyone thinking about going off-grid there, and the big news is that this county just got its first-ever countywide zoning code. That changes the picture from what you might read in older forum posts.

Zoning. Nemaha County adopted a Land Use Development Code with final approval reported on July 6, putting the whole unincorporated county (outside the extraterritorial jurisdictions of Sabetha and Seneca) under an "agriculture" zoning designation. Only ten listed land uses need a special use permit under this new code, according to the county. Cities like Sabetha still run their own separate zoning inside city limits and their ETJ. This is a brand-new framework, so I'd treat anything you read elsewhere about "no zoning in Nemaha County" as outdated, and confirm current details with the Planning Commission.

Dwellings, tiny homes, RVs. I could not find a countywide rule addressing tiny homes or RVs as permanent residences. Sabetha's own zoning ordinance defines campers and campgrounds, and it's explicit that a camper is "in no way intended to become a residence." That's a city rule, not a county one, and I have no confirmed county-level answer here, so ask the county directly if you're outside city limits.

Building codes. Kansas has no statewide building code; each city sets its own. I found no evidence of an independent building-code office for unincorporated Nemaha County, only city offices like Sabetha's. If you're building outside a city, confirm with the county clerk whether any building permit applies.

Septic. This one's real: Nemaha County adopted Environmental/Sanitation Codes back in 1993 requiring a permit for any private wastewater system installed since. NEKES (Northeast Kansas Environmental Services), the regional agency covering Nemaha and four other counties, designs, approves, and permits onsite systems, and only NEKES-licensed installers can do the work. This traces back to state rule K.A.R. 28-5-6, which requires wastewater go to an approved system.

Greywater. No dedicated greywater ordinance exists here that I found. But state and county rules broadly prohibit discharging sewage (which can include greywater) onto the ground, into waterways, old wells, or similar. So informal greywater dumping is legally shaky, even without a specific greywater permit process.

Rainwater. I found nothing restricting it at the county level. Kansas's domestic-use exemption under the Water Appropriation Act should cover typical rainwater catchment, though this isn't separately spelled out by the county.

Wells. NEKES inspects new wells and does water screening for bacteria and nitrates after drilling. Statewide, only KDHE-licensed contractors can drill or reconstruct wells. KDHE keeps a county-by-county list of well permit requirements, but I couldn't independently confirm Nemaha's specific listing, so check that page or call NEKES directly.

Utility disconnection. I found no rule forcing hookup to public power, water, or sewer as a condition of living somewhere in Nemaha County. If such a rule exists, it would most likely be a city ordinance, not a county one.

Bottom line: Nemaha County just became a zoned county, wastewater is tightly regulated through NEKES, and a lot of everyday off-grid questions (dwellings, building codes, utility hookup) simply aren't settled at the county level yet, so a phone call before you buy land will save you grief.
